Upon purchase, we grant you a limited, non-exclusive, non-transferable, revocable license to:

Download and access the Digital Products for your personal use only
Use the materials for your own English language learning purposes
Store the materials on your personal devices for offline access
Print one copy for your personal, non-commercial use

3.3 Prohibited Uses

You are strictly prohibited from:

Redistribution: Sharing, distributing, uploading, or making available the Digital Products to any third party through any means, including email, social media, file-sharing platforms, cloud storage shared with others, or physical distribution
Commercial Use: Using the Digital Products for any commercial purpose, including teaching, tutoring, or incorporating into commercial courses without explicit written permission from JayTen LLC
Public Display: Publishing, posting, or displaying the Digital Products on any website, blog, social media platform, learning management system, or any other public or semi-public forum
Reproduction: Copying, reproducing, translating, or creating derivative works based on our Digital Products
Reverse Engineering: Attempting to extract, modify, or reverse engineer any content, watermark, or protection mechanism from our Digital Products
Unauthorized Access: Sharing your account credentials, download links, or allowing others to access materials through your account
Mass Distribution: Distributing materials to groups, classes, schools, or organizations without proper licensing
AI Training: Using any portion of our Digital Products to train, fine-tune, or otherwise improve any artificial intelligence or machine learning model

5. Purchases and Payments

5.1 Payment Processing

All payments are processed securely through Shopify Payments. By making a purchase, you agree to Shopify's payment terms and authorize the payment amount. We do not store your full payment card information on our servers.

5.2 Refund Policy

Due to the digital nature of our products and immediate access upon purchase, all sales are generally final. Because Digital Products are delivered instantly and cannot be "returned," we are unable to issue refunds in most circumstances.

Refunds may be considered, at our sole discretion, only in the following situations:

The download link did not work and we are unable to deliver the file
The file you received is corrupted or unreadable and we are unable to provide a working copy
You were charged twice for the same product due to a technical error

Refund requests must be submitted within 14 days of purchase to support@bestenglishbooks.com with your order number and a description of the issue.

5.3 Pricing

Prices for Digital Products are listed in U.S. Dollars (USD) and are subject to change without notice. The price charged will be the price in effect at the time of purchase. Applicable taxes will be added at checkout based on your location.

6. Community Guidelines

When participating in our YouTube channel, Facebook page, Facebook group, or any other community we operate, you agree to:

Be respectful and courteous to other community members
Not share or request the sharing of copyrighted materials
Focus discussions on English learning topics
Not engage in spam, self-promotion, or unrelated commercial activity
Follow platform-specific rules (YouTube Community Guidelines, Facebook Community Standards)

7. Enforcement and Violations

7.1 Monitoring and Detection

We actively monitor for unauthorized use and distribution of our Digital Products through various means, including digital forensics, online monitoring, watermark tracing, and user reports.

7.2 Consequences of Violations

Violation of these Terms may result in:

Immediate termination of your account and access to all Services
Revocation of your license to use any Digital Products
Legal action to recover damages and seek injunctive relief
Reporting to appropriate authorities for copyright infringement
Liability for attorney fees, legal costs, and statutory damages

7.3 DMCA and Copyright Protection

We reserve the right to issue DMCA takedown notices for any unauthorized use of our copyrighted materials found online. We will pursue all available legal remedies for copyright infringement.

8. Service Availability

Once a Digital Product has been purchased and successfully downloaded, your access to that file is not dependent on the continued operation of the website.

9. Disclaimers and Limitations

9.1 Educational Purpose

Our Digital Products are designed for educational and self-study purposes. We make no guarantees about specific learning outcomes, language proficiency improvements, or exam results. Individual results vary based on effort, prior knowledge, and consistency of practice.

9.2 Limitation of Liability

To the maximum extent permitted by law, JayTen LLC, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services. Our total aggregate liability for any claim arising out of these Terms or your use of the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Third-Party Platforms

Our presence on YouTube, Facebook, Instagram, and any other third-party platform is subject to those platforms' respective terms of service. We are not responsible for changes to third-party platform policies, outages, or actions that may affect your access to our content on those platforms.

11. Termination

We may terminate or suspend your access to our Services immediately, without prior notice, for any violation of these Terms. Upon termination, your right to use our Services will cease immediately, although Digital Products you have already lawfully downloaded remain subject to the license restrictions above.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to the personal jurisdiction of such courts.

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.
